Terms of Service

Welcome to hobbyray.com. These terms are the agreement between you and Eternita LLC, 1627 S. River Grove Way, Eagle, ID 83616, USA ("Eternita", "we", "us") covering your use of hobbyray.com, the coin catalog, user collections and galleries, our mobile apps, and the Lucky Coin Store (together, the "Site").

By using the Site you accept these terms. If you do not accept them, please do not use the Site. Our Privacy Policy and, for purchases, our Return Policy are part of these terms.

These terms replace the separate Coin Vision Terms of Service (last modified February 10, 2018) and Hobbyray Terms of Service (last modified September 5, 2020). One document now covers the website, the apps and the store.

1. Who may use the Site

You must be at least 13 years old. If you are under 18, use the Site with a parent or guardian's involvement, and understand that placing an order requires an adult's payment method. By using the Site you confirm you can form a binding contract and are not barred from doing so under applicable law, including US sanctions and export and re-export control laws and regulations.

2. Your account

You may browse the catalog and the store without an account. To contribute content, save collections, or buy anything, you need one.

• Give accurate information and keep your email address current — it is how we reach you about orders.
• Keep your password to yourself. You are responsible for what happens under your account. Tell us at [email protected] immediately if you think someone else has access to it.
• One person, one account, unless we agree otherwise in writing. Do not create an account for someone else or under a name you have no right to use.
• We may send you service announcements, administrative messages and other information about the Site — including messages about your orders, your account, and changes to these terms. Some of these you can opt out of in your profile settings; the ones that concern your orders or your account security you cannot, because they are how we tell you something you need to know.
• You can close your account at any time by emailing [email protected]. Some public catalog contributions may remain — see section 3.

3. The catalog, and content you contribute

The coin catalog is a community project. Everything in this section is about the fact that other people will see, use, and often edit what you add.

You keep what you own. You keep all rights in the text, images, and other material you submit ("Your Content"). We do not claim ownership of it.

What you grant us. By submitting Your Content you grant Eternita a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, reproduce, adapt, publish, translate, publicly display and distribute it, in connection with operating and promoting the Site. This licence lasts as long as the content is on the Site, and survives afterwards to the extent we need it for backups, archives, and the version history described below. You also grant other users the right to view Your Content, and to build on it as part of the catalog.

What you promise. That Your Content is yours to submit, that it does not infringe anyone's copyright, trademark, privacy or other rights, that it is not unlawful, and that any coin images you upload are photographs you took or have permission to use. Do not upload images taken from auction houses, grading services, dealers or other catalogs — this is the single most common way people get themselves and us into trouble.

The catalog is edited collaboratively. Catalog and article pages are shared. Other contributors and we may correct, expand, restructure, translate or merge what you have written, and every version is retained in the page's history. If you would rather your writing were not treated this way, do not put it in the catalog.

We may moderate. We may edit, reclassify, hide or remove any content, with or without notice, including content that is wrong, misleading, off-topic, infringing or abusive. We are not obliged to monitor content, and the fact that something is still on the Site does not mean we have reviewed it.

Our side of it. The Site itself — its design, software, database structure, the compiled catalog as a whole, our apps, and the hobbyray.com, Coin Vision and Lucky Coin names and logos — belongs to Eternita or its licensors. Using the Site does not give you any intellectual property right in it or in content you access through it, and these terms do not grant you the right to use our branding or logos. Do not remove, obscure or alter any legal notice displayed on or with the Site. Individual facts about coins are not ours to own, but our compilation and presentation of them is. You may not copy, scrape or redistribute the catalog in bulk. See section 4.

Feedback you send us about the Site, we may use freely and without obligation to you.

4. Things you must not do

• Misuse the Site, or access it by any method other than the interfaces and instructions we provide.
• Scrape, crawl, spider, bulk-download or systematically extract the catalog, listings, images or user data — by any means, including automated tools, headless browsers, or AI agents — without our prior written permission. Normal search-engine indexing under our robots.txt is fine.
• Resell, republish or redistribute the catalog, in whole or in substantial part.
• Interfere with the Site: no attacks, no attempts to overload it, no probing, scanning or testing our security, no bypassing rate limits, authentication, CAPTCHAs or caching.
• Access another user's account, or hold yourself out as someone you are not.
• Post malware, spam, advertising, chain messages, or links whose purpose is to move people off-site.
• Post anything unlawful, hateful, harassing, defamatory, obscene, or invasive of someone's privacy.
• Use the Site to offer, promote or sell counterfeit, replica or altered coins, stolen property, or anything whose sale is restricted where you or the buyer are. Misrepresenting a coin's date, mint, grade, variety or authenticity is a serious violation.
• Use the Site or anything from it to train machine-learning models, without our prior written permission.
• Collect personal information about other users, or contact them for marketing.

We may suspend or stop providing the Site to you if you do not comply with these terms, or while we are investigating suspected misconduct — see section 15.

5. Our mobile apps

We publish two Android apps, and these terms cover both:

• CoinVision — coin identification from a photograph. play.google.com/store/apps/details?id=net.coinshome.coinvision
• Hobbyray Organizer — organising and searching your own collection. play.google.com/store/apps/details?id=com.hobbyraymobile

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps on devices you control, for as long as you comply with these terms. Do not copy, modify, reverse engineer, decompile or redistribute them, except where the law says you may despite this sentence. The apps are distributed through Google Play, and Google's own terms govern the download itself. Charges from your mobile carrier for data are yours.

Do not use the apps in a way that distracts you from obeying traffic or safety laws. Identify coins when you are not driving.

Coin identification results are suggestions produced by software, not appraisals or attributions. They are often wrong, in the ordinary way that image recognition is wrong, and section 8 applies to them in full. Photographs you take in the apps and upload are Your Content under section 3, and our Privacy Policy describes what happens to them.

We update the apps from time to time, and old versions may stop working against our servers — see section 11.

6. Third-party services and links

The Site relies on other companies — PayPal for payments, Google for sign-in, app distribution, analytics and advertising, Amazon Web Services for hosting and images, and shipping carriers for delivery. Their own terms and privacy policies govern what they do; see our Privacy Policy. The Site also displays content that is not ours, and that content is the responsibility of whoever made it available. Links to other sites, dealers, auction results and grading services are for reference. We do not control them, we do not endorse them, and we are not responsible for them.

7. Buying from the Lucky Coin Store

We are the seller. Coins in the Lucky Coin Store are sold by Eternita LLC, trading as Lucky Coin Store. When you buy, your contract is with us.

United States only. We sell and ship only within the United States — the 50 states and the District of Columbia. Orders with any other shipping address are cancelled and refunded before shipment. Prices are in US dollars.

Almost everything is one of a kind. Each listing is normally a single specific coin. Adding a coin to your cart does not reserve it; it is held only briefly once you start checkout, and it is sold to whoever completes payment first. If the coin sells while you are paying, we will refuse or refund the payment and tell you.

Prices and descriptions can be wrong. We try hard to get them right, and occasionally a price, image, availability or description will be mistaken. We may correct an error and, where a listing was materially mispriced, cancel the order and refund you in full rather than complete it. We will not charge you more than the price shown without your agreement.

Your order is an offer. An order confirmation acknowledges that we received it; the contract forms when we accept the order by shipping it. We may decline any order — including where we cannot verify the payment or address, where stock has gone, or where we suspect fraud.

Payment. Payment is taken through PayPal. We never see or hold your card or bank details. By paying you confirm you are entitled to use the payment method.

Shipping and risk. We ship only to the address confirmed on your PayPal payment. Title and risk of loss pass to you on delivery to you by the carrier. Delivery estimates are estimates.

Tax. We do not currently collect US sales or use tax. Depending on where you live you may still owe use tax on your purchase; that is between you and your state.

Returns. Governed by our Return Policy, which forms part of these terms: 14 days from delivery, buyer pays return shipping, refund issued once we have received and inspected the return, and bullion-priced items are final sale.

8. Grading, descriptions and authenticity

Grades and attributions we publish — ours, a contributor's, or one suggested by our apps — are opinions, not guarantees. Numismatic grading is subjective, and independent experts routinely disagree by a grade or more. Photographs are taken under lighting that cannot reproduce a coin exactly; colour and lustre in particular will differ from what you see in hand.

The exception is authenticity: if a coin you bought from us is determined by NGC, PCGS or ANACS not to be genuine, our Return Policy gives you a full refund on its return, and we do not put a time limit on that.

Catalog information — mintages, values, varieties, catalog references — is contributed by the community and offered for reference. It may be incomplete or wrong, and it is not a valuation of your coin.

9. Not investment advice

Nothing on the Site is financial, investment, tax or legal advice, and nothing here is an offer or recommendation to buy or sell as an investment. Coins and precious metals are collectibles whose value fluctuates, sometimes sharply, and you can lose money on them. Prices, estimates and past auction results describe the past. Please make your own enquiries, and take professional advice, before treating any coin as an investment.

10. Copyright complaints

If you believe something on the Site infringes your copyright, send our designated agent a notice containing: identification of the work; identification of the material and where to find it on the Site; your contact details; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature.

We remove infringing material and may terminate the accounts of repeat infringers. If you believe your material was removed in error you may send a counter-notice. Knowingly submitting a false notice can make you liable for damages.

11. Changing and discontinuing the Site

We are constantly changing and improving the Site. We may add or remove features, and we may suspend or stop any part of it altogether — including an app, or support for an older version of one.

You can stop using the Site at any time, and we may stop providing it to you, or set new limits on it, at any time.

Your data is yours. If we discontinue a part of the Site you have been using, then where it is reasonably possible we will give you reasonable advance notice and a chance to get your information out of it first.

12. The Site is provided as it is

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy or completeness of catalog information or of anything our apps identify. We do not promise the Site will be uninterrupted, secure or error-free, that defects will be fixed, or that anything you store on it will not be lost.

Nothing here limits any warranty that applies to a coin we sold you, or any right you have under consumer-protection law that cannot be waived. Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13. What we are liable for

To the maximum extent the law allows:

• We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or the cost of substitute goods, arising from your use of the Site — even if we were told such damages were possible.
• We are not liable for any loss or damage that is not reasonably foreseeable.
• Our total liability for any claim relating to the Site or these terms is limited to the greater of the amount you paid us for the order the claim relates to or US $100.

These limits do not apply to our own fraud, or to any liability that cannot be limited by law — including, in most states, liability for death or personal injury caused by negligence. Some states do not allow these limitations, so parts of this section may not apply to you.

14. Indemnity, and using the Site for a business

You agree to indemnify and hold Eternita LLC, and its affiliates, officers, agents and employees, harmless from claims, losses and reasonable legal costs — including litigation costs and attorneys' fees — arising from Your Content, your breach of these terms, or your unlawful use of the Site. We may take over the defence of any such claim, and you agree not to settle it without our consent.

If you use the Site on behalf of a business, that business accepts these terms, and this section applies to it.

15. Suspension and termination

You can stop using the Site at any time. We may suspend or terminate your access, remove your content, or cancel pending orders if you breach these terms, if we are required to, if we are investigating suspected misconduct, or if we reasonably believe it is necessary to protect the Site or other users. Where circumstances allow we will tell you why. We will still honour and refund any order you have already paid for, under the Return Policy.

Sections 3 (the licence you granted, and our rights), 12, 13, 14 and 16 survive termination.

16. Disputes and governing law

Talk to us first. Email [email protected] and give us 30 days to sort it out. Almost everything is resolved this way, and it is faster than any alternative.

These terms are governed by the laws of the State of Idaho and applicable US federal law, without regard to conflict-of-law rules. If we cannot resolve a dispute informally, it will be brought exclusively in the state or federal courts located in Ada County, Idaho, and we each consent to their jurisdiction. If you are a consumer in a jurisdiction whose law gives you the right to bring proceedings locally, this does not take that right away.

The UN Convention on Contracts for the International Sale of Goods does not apply.

17. Changes to these terms

We may change these terms — for example to reflect a change in the law or in the Site. We will update the "Last updated" date, and for material changes we will give notice on the Site before they take effect. Changes are not retroactive and take effect no sooner than 14 days after they are posted, except changes covering a new feature and changes made for legal reasons, which take effect immediately. Continuing to use the Site after a change means you accept the new terms. If you do not, stop using the Site and close your account. Changes do not apply to an order already placed.

18. The small print

These terms, with the Privacy Policy and Return Policy, are the entire agreement between us about the Site. They control the relationship between Eternita and you, and do not create rights for anyone else. If any provision is unenforceable, the rest stands and that provision is limited to the minimum extent necessary. If we do not act on a breach straight away, we have not given up the right to act later. You may not transfer your rights under these terms; we may transfer ours in connection with a merger, acquisition or sale of assets. Nothing here creates a partnership, agency or employment relationship. We are not liable for failures caused by events outside our reasonable control.
